By accessing or using Chromacraft (the "Service"), including our macOS application, Figma plugin, and website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

Chromacraft is an AI-powered color system generator that helps designers and developers create production-ready color palettes and design tokens. The Service includes a macOS application, a Figma plugin for syncing design tokens, and a backend API for AI generation.

3. Credits and Purchases

Credits: AI-powered features require credits. Each AI generation uses 1 credit. Credits never expire.

Free Credits: New users receive 3 free credits to try the Service.

Purchases: Additional credits can be purchased through the macOS App Store. All purchases are processed by Apple and are subject to Apple's terms and conditions.

Refunds: Refund requests must be directed to Apple through their standard refund process. We cannot process refunds directly.

4. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Reverse engineer or decompile the software
  • Use automated means to access the Service without permission
  • Share or resell your account or credits

5. Intellectual Property

Our Content: The Chromacraft application, website, and all associated trademarks, logos, and content are owned by us and protected by intellectual property laws.

Your Content: You retain ownership of any color palettes, design tokens, and other content you create using the Service. By using the Service, you grant us a limited license to process and store your content as necessary to provide the Service.

AI-Generated Content: Color palettes and design tokens generated by our AI are provided for your use. You may use them in your personal and commercial projects without attribution.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI-GENERATED CONTENT MAY NOT ALWAYS MEET YOUR EXPECTATIONS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS.

8. Service Modifications

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

9. Termination

We may terminate or suspend your access to the Service at our discretion if you violate these terms. Upon termination, your right to use the Service will immediately cease, and any unused credits will be forfeited.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of any material changes by posting the new terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new terms.

11. Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
